By accessing our website at suisuncityheavydutytowing.com or by requesting towing or recovery services from Suisun City Heavy Duty Towing, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our website or services.
We may update these terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
Suisun City Heavy Duty Towing provides towing, vehicle recovery, roadside assistance, and related services in Suisun City, CA and surrounding communities. Services are provided on a call-by-call basis and are subject to availability. We reserve the right to decline any service request at our sole discretion.
All information on our website, including service descriptions and coverage areas, is provided for general informational purposes and may change without notice. Website content does not constitute a guarantee of service availability or pricing.
Any estimate provided by Suisun City Heavy Duty Towing, whether by phone, email, or through our website contact form, is an approximation only. Final pricing is determined at the time of service based on the actual scope of work, vehicle type and weight, distance, time of day, difficulty of the recovery, and any applicable permit or regulatory requirements.
We will make reasonable efforts to provide a clear rate structure before beginning work. California law may regulate the rates we can charge for certain types of tows, particularly those initiated by law enforcement. You have the right to ask for a written or verbal rate disclosure before services begin.
Prices are subject to change without notice. Any price quoted verbally or in writing is valid only for the specific service described at the time of the quote.
For non-emergency scheduled services, we will make reasonable efforts to honor the agreed appointment time. We are not liable for delays caused by traffic, weather, prior emergency calls, or other circumstances outside our control.
If you need to cancel a scheduled service, please notify us as soon as possible by phone at (707) 210-9220. Cancellations made after a truck has been dispatched to your location may be subject to a trip or response fee.
For emergency calls, response time estimates are provided in good faith and are not guaranteed. We will dispatch the nearest available appropriate unit as quickly as possible.
Payment is due at the time of service unless a prior billing arrangement has been established. We accept payment by cash, credit card, or debit card. Fleet operators and commercial accounts may contact us to discuss invoicing arrangements.
In the event of non-payment, we reserve the right to exercise any lien rights available under California law, including the right to retain a vehicle until charges are paid. Storage fees accrue from the time a vehicle arrives at our yard.
Any disputes regarding charges must be raised within 30 days of the service date. After that period, all charges are considered accepted.
You agree to:
We will take reasonable care in handling your vehicle. However, Suisun City Heavy Duty Towing is not liable for pre-existing damage, mechanical conditions, or damage that is a direct result of the vehicle's own condition at the time of service.
You acknowledge that towing and recovery operations, particularly involving vehicles in unusual positions (rolled over, off-road, or partially submerged), carry inherent risks. We will use professional judgment and appropriate techniques, but cannot guarantee that no damage will occur during a complex recovery.
Claims for damage alleged to have occurred during a tow or recovery must be reported to us in writing within 24 hours of the service. Failure to report within this window may limit your ability to pursue a claim.
If a vehicle is placed in our storage facility, daily storage fees begin accruing from the time of arrival. We will make reasonable efforts to notify you of storage fees when applicable. Vehicles unclaimed after a period determined by applicable California law may be subject to lien sale proceedings.
To retrieve a stored vehicle, you must provide valid photo identification, proof of ownership (vehicle registration or title), and payment of all accrued charges. Additional documentation may be required if the vehicle was towed at the direction of law enforcement.
To the maximum extent permitted by law, Suisun City Heavy Duty Towing and its employees, contractors, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services or your use of our website, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from a service we provide shall not exceed the amount you paid for that specific service.
Nothing in these terms limits our liability for gross negligence, willful misconduct, or any liability that cannot be excluded or limited by law.
Our website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.
We make no warranties regarding the accuracy, completeness, or timeliness of information on our website, including service area coverage, availability, or pricing.
We encourage you to contact us directly to resolve any dispute. Please reach out by phone at (707) 210-9220 or by email at hi@suisuncityheavydutytowing.com. We will make a good-faith effort to resolve your concern promptly.
If a dispute cannot be resolved informally, both parties agree to submit the matter to binding arbitration in Suisun City, CA, administered under the rules of the American Arbitration Association. You waive your right to a jury trial and to participate in a class action lawsuit to the fullest extent permitted by law.
These terms do not limit your rights under any applicable consumer protection laws.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to these terms or our services shall be brought exclusively in a court of competent jurisdiction in California.
